Search Engine Optimisation Terms and Conditions
YOU MUST AGREE TO THESE TERMS AND CONDITIONS BEFORE USING ANY SERVICE PROVIDED BY A.N.A PUBLISHING LIMITED OR ASSOCIATED COMPANIES. BY USING, AND CONTINUING TO USE, THIS SERVICE YOU INDICATE YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS OF USE AND AGREE TO BE BOUND BY THEM. THESE TERMS ARE A LEGALLY BINDING CONTRACT WHICH DO NOT AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER.
Definitions
The "Customer" means the user. "Services" means all services provided by A.N.A Publishing Limited. "Users" means any individual who has been given access to a Customer's records by A.N.A Publishing Limited or the Customer's System Administrator. "Terms of Service" and "Terms and Conditions" are used interchangeably on this page.
Supply
A.N.A Publishing Limited agree to provide the services to the Customer to the extent described in our web site and any supporting documentation which shall be deemed and incorporated into these terms and conditions.
A.N.A Publishing Limited reserve the right to alter or withdraw any service at any time on giving current Customers prior warning.
Exclusion of Warranties
Save as expressly set out herein, all conditions or warranties which may be implied or incorporated into these terms and conditions by law or otherwise are hereby expressly excluded to the extent permitted by law. In no circumstances whatsoever will A.N.A Publishing Limited be liable for economic, indirect or consequential loss.
A.N.A Publishing Limited's Services are provided on an "as is" and "as available" basis and we make no warranties or representations, whether express or implied, in relation to A.N.A Publishing Limited or our Services, including but not limited to, implied warranties or conditions of completeness, accuracy, satisfactory quality, or any loss of data resulting from delays, non-deliveries, missed deliveries, data corruption (however caused), or service interruptions.
In any event the liability of A.N.A Publishing Limited to the Customer in respect of an event or series of connected events arising out of or in connection with these terms and conditions whether in contract, tort (including negligence) or otherwise shall be limited to all sums payable and paid in respect of the Services provided and shall not exceed the equivalent monthly charge in effect at the time the liability occurred.
Each provision of this Clause 3 excluding or limiting liability shall be construed separately, applying and surviving even if for any reason one or other of those provisions is held inapplicable or unenforceable in any circumstance they shall remain in force notwithstanding the termination or expiry of these terms and conditions.
Payment
All customers using A.N.A Publishing Limited Web Promotions Services are required to pay the total costs of the campaign before we commence your campaign.
If customers are signing up for our “PPC” Advertising Campaign service – you are required to pay the management fees and monthly budget for the length of your campaign, before we commence your campaign. We reserve the right to negotiate fees for customers running “PPC” campaigns for more than one month.
Accounts in default will be charged interest on the outstanding balance at an annual rate of 8% above Nationwide Building Society's base lending rate. Interest will be added daily. All payments due under these terms and conditions shall be made by the Customer in full without any right of set-off by the Customer.
A.N.A Publishing Limited reserve the right to terminate the services to the Customer forthwith in the event of any default of payment. Failure to pay within 7 days of invoice will result in the suspension of service to the customer. There is a set-up charge of £50 to reinstate the services to the Customer on each occasion that the service needs to be reinstated.
All charges and invoices are due within 7 days of invoice.
Electronic or online invoices will be deemed to have been delivered on the day of sending. It is the clients responsibility to keep their contact details and email addresses up-to-date on the online Control Panel. Invoices that are raised manually, and posted, are deemed to have arrived on the second day after posting.
Payment Liability A.N.A Publishing Limited reserves the right to hold Customers liable for all outstanding balances owed to us. Action will be taken to recover the monies owed to us if payment is not made within the stated amount of time.
Acceptance
A.N.A Publishing Limited will have absolute discretion as to whether or not we accept a customer. This decision will be final. If we do not accept, we will explain why.
A.N.A Publishing will not advertise any site that contains material not deemed to be appropriate for a general audience e.g. we will not accept the following sites :
1) Sites containing or linking to
software piracy.
2) Sites with child pornography or sites that contain links to such
content.
3) Sites containing or linking to any form of illegal activity (i.e.,
how to build a bomb, hacking etc.).
4) Sites with gratuitous displays of violence, obscene or vulgar
language, and abusive content or content which endorses or threatens
physical harm.
5) Sites promoting any type of hate-mongering (i.e., racial, political,
ethnic, religious, gender-based, sexuality-based or personal, etc.).
6) Sites that participate in or transmit inappropriate newsgroup
postings or unsolicited e-mail (spam).
7) Sites promoting any type of illegal substance or activity sites with
illegal, false or deceptive investment advice and money-making
opportunities.
8) Sites with any type of content reasonable public consensus deems to
be improper or inappropriate .
If customers change the content on their site(s), you must immediately notify A.N.A Publishing Limited in writing (E-Mail will be accepted) seeking their approval. If any of the terms above are broken, at any stage of the campaign, you will not be entitled to a refund and A.N.A Publishing may seek damages against you in a court of law.
A.N.A Publishing limited will under no circumstances consider advertising page(s) containing pop up’s or pop under. If any of these page(s) are added during the campaign, you will not be entitled to a refund.
Your page(s) must not contain music.
Your page(s) must not contain any scripts containing code altering any user browser settings or delivering cookies to the user.
A.N.A Publishing Limited will not consider advertising any web sites containing Frames.
A.N.A Publishing Limited will consider advertising Dynamic web site, however this is at our discretion.
If A.N.A Publishing Limited accepts your site we require the following link to be placed on every page of your site :
The minimum length of contract for our Managed Web Marketing services is 1 year.
Reports
All campaigns run by A.N.A Publishing Limited are tracked continually and reports are made available for viewing by our customers. Customers will not be allowed to use their own tracking software with any of our advertising programmes.
